hynix Semiconductor Inc. is disappointed with the jury verdict today that Rambus did not violate the antitrust laws or commit fraud in deceiving industry members and JEDEC by seeking patents on aspects of the JEDEC standard memory interface. This verdict is at odds with the unanimous decision of the US Federal Trade Commission, and a similar decision by the European Commission, that Rambus engaged in deceptive conduct in its JEDEC participation.
The validity of some of the patents Rambus is asserting against JEDEC standard products, and which are involved in the district court case, is currently under review at the US Patent and Trademark Office. The PTO recently rejected all of the claims of a key Rambus patent in a preliminary ruling. The European Patent Office has also canceled certain Rambus patents asserted against JEDEC standard products.
hynix strongly believes that the jury’s verdict is contrary to the law and the facts and intends to continue to pursue all of its legal options to establish the principle that patent traps and anticompetitive abuse of a standard setting organization is illegal.
