Hyundai Amends Complaint

– Hyundai Electronics and Hyundai Electronics America of San Jose, California, filed an amended complaint in their action against Rambus, Inc. of Mountain View, California, currently pending in the United States District Court in San Jose.

San Jose, CA, October 18, 2000 — Today, Hyundai Electronics Industries Co., Ltd. of Seoul, Korea, and Hyundai Electronics America of San Jose, California, filed an amended complaint in their action against Rambus, Inc. of Mountain View, California, currently pending in the United States District Court in San Jose. The amended complaint asserts that Rambus has engaged in anticompetitive, exclusionary, and unfair conduct by manipulating the standards-setting process of JEDEC, a semiconductor industry association that developed industry-wide technical standards for DRAMs while Rambus was a member. Hyundai claims that Rambus violated JEDEC rules requiring members to disclose patent rights relevant to standards under consideration by the organization. Hyundai seeks treble damages and injunctive relief for violation of the antitrust laws, as well as an order from the Court that certain Rambus patents are invalid, unenforceable, and not infringed by any Hyundai products. Hyundai originally filed the lawsuit on August 29, 2000 in response to an assertion of infringement by Rambus and a demand that Hyundai accept and pay royalties for a license under the Rambus patents. In the amended complaint, Hyundai Electronics U.K., Ltd. of Surrey, United Kingdom, and Hyundai Electronics Deutschland GmbH of Raunheim, Germany, have joined the action as co-plaintiffs.
